Who should attend?
Kenya’s Data Protection Act, 2019 came into force in 2019. The Act requires certain organisations to take measures to protect customers’ personal data in their possession.
According to the Data Protection Regulations, organisations processing personal data for the following purposes are required register as a data handlers:
- Canvassing political support among the electorate.
- Crime prevention and prosecution of offenders (including operating security CCTV systems).
- Gambling.
- Operating an educational institution.
- Health administration and provision of patient care.
- Hospitality industry firms but excluding tour guides.
- Property management including the selling of land.
- Provision of financial services.
- Telecommunications network or service providers.
- Businesses that are wholly or mainly in direct marketing.
- Transport services firms (including online passenger hailing applications)
- Businesses that process genetic data.
Compliance with the law is still required even if your organisation has not yet registered.
Since the introduction of the Act, loss or misuse of citizen data by data processors has frequently resulted in heavy fines on data processors, often in excess of KShs. 250,000/- per incident.
